Personal Injury Valuation
Personal
injury cases typically entail consideration of past earnings
losses, the present value of the future loss (or diminution) of
earning capacity, and the present value of future medical costs
to be incurred. The diminution of future earning capacity
usually is based on the conclusions of physicians or
rehabilitation counselors relative to the employability of the
plaintiff in the competitive labor market. The type, level, and
duration of future medical costs to be incurred are based on the
conclusions of medical care experts. Wrongful deaths cases
involve the loss of support to dependents based on the loss of
earnings/earning capacity of the decedent.
